In February 2013, Bayer’s pharmaceutical division released its 2012 annual report that detailed the approximately 43 percent decline in earnings the drug company experienced last year. Reuters reported that this loss in earnings is not because of a decrease in sales, but largely in part due to the more than $1.5 billion Bayer has put aside for current and future Yaz, Yasmin and Ocella lawsuits. These lawsuits are seeking damages for victims who have suffered serious injuries because of the company’s negligence in failing to warn them of potentially harmful side effects associated with the oral contraceptives.
However, the decreased amount Bayer reported is insignificant compared to the massive profits the drug company continues to make. Even though the potentially dangerous drugs pose as a known threat to women—the US Food and Drug Administration (FDA) reported the drugs raise a patient’s risk of developing deep vein thrombosis, pulmonary embolism and blood clots by roughly 75 percent—Bayer continues to profit from these birth control pills.
There are approximately 10,000 Yaz lawsuits currently pending in court against Bayer, but there are thousands of women affected that have not yet sought legal recompense. Unless Bayer rectifies the situation, there will likely be thousands more.
Our firm has conducted independent investigations into the false advertising practices used by Bayer to deceptively market the use of Yaz, Yasmin and Ocella to its consumers. Additionally, our class action attorneys have been heavily involved in litigation against Bayer since victims began experiencing these known Yaz side effects.
