According to Bloomberg.com, the Danish maker of a vaginal mesh implant has agreed to pay about $16 million to settle lawsuits accusing the company of injuring women.Photo of mesh product
Denmark-based Coloplast agreed in January to resolve about 400 suits over the inserts, a source told Bloomberg.com. The settlement will provide an average payment of about $40,000 for each claimant.
Across the U.S., about 29,000 other plaintiffs are suing other vaginal mesh manufacturers, including C.R. Bard, Endo Health Solutions, Boston Scientific and Cook Medical Systems, claiming that the devices have eroded through internal organs, often causing injuries to tissues, while causing pain, bleeding and urinary problems.
Johnson & Johnson, the largest manufacturer of vaginal mesh products, has refused to join settlement negotiations. However, news that settlements are taking place may be a good sign for plaintiffs.
“It appears that momentum is building for some type of global resolution as more of these vaginal mesh cases settle,” Carl Tobias, a product-liability law teacher at the University of Richmond in Virginia, told Bloomberg in an e-mail.
It should be noted that the FDA estimated that 300,000 women had pelvic organ prolapse surgery in 2010, and transvaginal mesh was used in a third of procedures.
