Two woman who developed bladder cancer after taking Actos, lost their trial against the drug’s manufacturer, Takeda Pharmaceuticals.The Las Vegas jury came to its verdict last month and involved Las Vegas resident, Bertha Triana and Henderson resident, Delores Cipriano. Actos is used as a blood-sugar control product in adults with Type 2 diabetes.
This verdict does not mean however, that pending litigation against Takeda should be shelved. It should be noted that in April, a Louisiana jury ordered Takeda to pay $6 billion in punitive damages in a case involving Actos, which Takeda is appealing.
The Nevada trial was marred in controversy after it began in February. At one point, District Judge Kerry Earley heard arguments from the plaintiffs’ attorney who said that the lawyers representing Takeda were acting disrespectfully in the courtroom.
The lawyers reportedly were reprimanded for their conduct, which included pointing fingers and rolling eyes.
The plaintiffs are expected to file an appeal, which may include an argument that the Plaintiffs are entitled to a new trial based on the misconduct of Takeda’s lawyers.
