In a motion filed on December 2, Plaintiffs in the federal multi-district transvaginal mesh litigation asked the judge to impose “severe sanctions”against Johnson & Johnson’s Ethicon subsidiary for alleged mishandling and destruction of thousands of documents in the case. The litigation is pending in the United States District Court for the Southern District of West Virginia before the Honorable Joseph R. Goodwin.
These documents were needed to fully present the plaintiffs’ injury claims to jurors at the upcoming bellwether trials. The first bellwether trial in Lewis, et al. v. Johnson & Johnson, et al., 2:12-cv-04301, is scheduled to commence on February 10, 2014. The second bellwether trial is scheduled for June 23, 2014 in Huskey, et al. v. Ethicon, Inc., et al., 2:12-cv-05201.
