According to the Associated Press, advocates are urging the Justice Department to investigate claims that Johnson & Johnson (J&J) deliberately destroyed documents relating to ongoing transvaginal mesh lawsuits.
The AP reported that the Corporate Action Network, a nonprofit organization, said that it has written to Attorney General Eric Holder asking his office to look into whether J&J and CEO Alex Gorsky committed the crimes of obstructing justice and destroying records in a federal probe.
“Hundreds of thousands of women continue to suffer ongoing, severe harm,” network representative Levana Layendecker said, according to the AP. “I hope Johnson & Johnson is held accountable for their failure to warn.”
In March, U.S. District Court Judge Cheryl Eifert, who is handling most of the implant lawsuits in southern West Virginia, concluded that the company destroyed thousands of documents regarding development of the defective transvaginal mesh implants, but said there was no proof that it was done intentionally.
Many people find it deeply bothersome, even horrific, that, while so many women are suffering, Johnson&Johnson destroyed evidence relating to the cases that they have filed. Currently, the company is facing more than 2,000 lawsuits nationwide over its subsidiary Ethicon’s mesh products.
Many women have claimed that these products have caused them organ damage, and issues with sexual intercourse. They have also been linked to erosion and displacement.
Aside from J&J, other transvaginal mesh makers include C.R. Bard, Endo Health Solutions, Boston Scientific and Cook Medical Systems.
